Checking a flat before buying in Lviv
How to check a new build
A new-build check has five parts: the developer, the land under the building, the permits, the contract you're being offered, and encumbrances. The problem most often hides in the land. If the plot is in a court dispute, the building risks never being commissioned, and the buyer is left with neither a flat nor money.
Investment, preliminary or sale agreement
In new builds a sale agreement is rarely signed straight away. More often you're offered an investment or preliminary agreement. They protect the buyer differently, and that's worth understanding before you hand over the money.
Deposit or advance
An advance is simply returned. A deposit works differently: if the buyer is at fault, the money stays with the seller; if the seller is at fault, they return double. But only if the deposit is made in writing and tied to a contract for the deal itself. A handwritten receipt without a contract usually turns into an ordinary debt.
A flat on the secondary market
On the secondary market I check the owners and how they acquired the flat, seizures and mortgages, and whether anyone else has a claim to the home. I support the deal through to registration of ownership.
